in san jose late friday night. it began just before 11:00 on pat avenue and lasted for nearly six hours. san jose police say an officer trying to break up the party was injured when people threw bottles at him. someone even tried to drag the officer into the backyard. he was able to get away. police say partygoers started jumping over fences when they arrived. but one woman at the party sees things differently. >> did you see any police officers? >> yes, i seen police officers. there was like 50 of them. >> and what were they doing? >> being aggressive. >> thirty-three adults and nine juveniles were taken into custody. in all two police officers were injured. it took 60 officers to restore order. >>> a touching memorial service this weekend for a man who was shot and killed by armed robbers outside a 711 store last week. this morning both suspects are in custody. rory park pettiford was killed by two men who went on a crime spre november 16th. friends and family remembered the 22-year-old. abc7 news reporter john alston was at the service. >> reporter: hugs and tears outside the campbel

very hotly contested votes in san jose. tonight. a david and goliath showdown over raising the minimum wage. it is winning, 57% to 43%, winding handily right now. it would impact 50,000 san jose workers by increasing the minimum wage from 8 to $10 an hour. that's with 14% of the precincts reporting. >> this originated as a chas project from san jose state. but it has turned into a heavy weight battle. >> reporter: the folks here at local labor unions like the way it is going tonight with measure d. the south bay labor council is a powerful coalition of unions. they were careful not to call it a victory speech but if this passes it will touch a lot of lives. >> anyone know what this means tonight? 50,000 people in san jose, the tenth largest city in the country, are going to get a raise. victory for minimum wage earners here in san jose. let's talk about measure "d." that's the minimum wage measure in san s leading with the majority of precincts reporting. with the presumed passage of measure d, the hourly rate will go up $2 an hour from the state rate of $8 to $10 an hour. those for measure d argue this was a moral necessity given how expensive it is to live in silicon valley. others say it will hurt the market as higher wages force companies to cut back on hiring. measure e. that's the measure. around 60% have said no. measure e would have allowed san jose's two card rooms to add more gaming tables resulting in more tax revenue for the city. proponents saying as much as $5 million more a year for things like plisholice, fire and libra. opponents argue card rooms would have added more crime. coming up, reaction from mayor chuck read not only about those two measures but about council woman rose herrera winning last night. that story coming up. meantime, reporting live here in san jose, bob rodell "today in the bay." >>> let's get the weather out there. the reality of fa

problem. a shortage of police officers. facing lower wages and cut benefits, more officers in san jose are resigning. there are new less than 1,000 officers in that department available for full duty. and only 70% of those are out on the street. cbs 5 reporter kid doe says there is a silver lining. >> reporter: he caught a burglar red-handed in his bedroom. >> surprising. you don't expect somebody in your home that doesn't belong there. >> reporter: he used to be the neighborhood watch vice president and says there have been about 10 break-ins in the past six months. >> we're a very large city with a very small force. when things go wrong, we need officers there to support us and be the law. >> reporter: san jose police have written a special memo to the city. >> the numbers are not good. and they are not going to be good for some time. >> reporter: they went from a high of 1 four 20 officers to 194 today -- 1,094 today. minus detective, the port staff, and administration, you're left with just 583 officers for patrol. >> there is no wiggle room. any time you move personnel out of here

in san jose with more on both of the measures named "a." bob, good morning. >> reporter: good morning, marla. voters dropping off ballots in thing south bay must not only consider a sales tax increase on the state level, of course, i'm referring to 30 and 38, but also on the county level as well. if measure "a" is passed in santa clara county, it would raise sales tax to 8.5% for ten years. tying it for the third highest sales tax in the state. it would raise about $50 million annually. this would help restore services that have been cut in recent years like police and public safety and health care coverage and housing for people living on the streets. >> i voted in favor of the tax. i thought it was a small price to pay. it seemed like the purpose of the tax and where the money would go would be a good thing for the community. >> i say it is difficult to pay extra taxes. >> i think it's needed. i'm prepared to do my part. it's like dues paying members of a community. you want to see something happen. you pay your dues. >> reporter: i'm sure you recognize congress member mike honda. h
